1. Who we are

FirstSpotted (firstspotted.com) is run by FirstSpotted, United Kingdom. Email: hello@firstspotted.com. In these terms “we” and “us” means FirstSpotted, and “you” means anyone using the site.

By creating an account, subscribing or paying for anything on the site, you agree to these terms. Please also read our privacy notice.

2. What FirstSpotted is

FirstSpotted is a daily discovery list. Each day we show a short list of verified creators to brand marketers and agencies. We are a media and advertising service, not an agency or marketplace: we don’t represent creators, negotiate deals, or hold or pass on money between creators and brands. Any deal between a creator and a brand is between them alone.

3. Who can use it

• You must be 18 or over.
• You may only add social accounts that you own or are authorised to manage, and they must be genuine (no bought followers or fake engagement).
• You are responsible for keeping access to your email secure, since we log you in by email link.

4. Free features

Joining, verification, your public profile and the daily brand email are free. Our team chooses Editor’s picks each day on merit. Being listed does not mean you will be picked, and we don’t have to explain our choices.

5. Fast-track (paid)

• A fast-track spot costs £3 (including any VAT that applies) and gives one approved card a guaranteed place in the next day’s list, which runs from 00:00 to 23:59 UTC.
• You pay in full when you book. Payments are processed by Stripe.
• Fast-track spots are always labelled Sponsored. There are only a few each day: at most 2 per category, and in total no more than about a third of that day’s list. They appear in set positions in the list (never first), and their order among themselves changes daily.
• You are buying a place on our site and in our email for that day. We do not promise any number of views, clicks, followers, sales, brand deals or any other result.

6. Cancellation and refunds

• Before your day starts: you can cancel for a full refund at any time before 00:00 UTC on the day of your spot. Just email hello@firstspotted.com from your account email.
• Once your day has started: when you book, you ask us to provide the service straight away and you agree that you lose your right to cancel once your spot has run. UK law normally gives consumers 14 days to cancel a service. Because your spot runs within that time, the right ends when the service has been fully provided.
• If we don’t show your spot (for example a technical fault, or we remove a card for reasons that aren’t your fault), we refund you in full, or move your spot to another day if you prefer.
• If we remove your card because it breaks these terms, we don’t have to give a refund.
• Refunds go back to the card you paid with, normally within 5 to 10 working days.

Nothing in these terms affects your legal rights as a consumer.

7. Your content

You keep ownership of everything you submit (your handle, pitch, bio and photo). You give us a worldwide, free licence to show, resize and share it on the site, in our emails and on our social channels to promote you and FirstSpotted, for as long as your account is active and for a reasonable time afterwards in past lists and posts.

Your content must not be misleading, unlawful, sexual, hateful or violent. It must not infringe anyone’s rights, or promise followers, earnings or other results. We review every card before it can be featured. We may reject, edit for length or remove any card or account that breaks these terms.

8. Brands and shortlists

Creator profiles are for finding creators to work with. Don’t scrape the site, collect creators’ details in bulk, or contact them with spam. Paid shortlists are quoted and invoiced separately, and the price and what you get are agreed in writing before you pay.

9. Our liability to you

We take care to run the site well, but we provide it “as is” and can’t promise it will always be available or error-free. We are not responsible for what brands, creators or other users do, or for any dealings between them.

We do not exclude or limit our liability where the law doesn’t allow it. That includes liability for death or personal injury caused by our negligence, for fraud, and for your rights as a consumer. Otherwise, our total liability to you is limited to the amount you paid us in the 12 months before the claim. If you use the site for business, we are not liable for lost profits, business or opportunities.

10. Ending your account

You can close your account at any time by emailing us. We may suspend or close an account that breaks these terms, uses fake followers, or puts other users at risk.

11. Complaints

If something goes wrong, email hello@firstspotted.com. We aim to reply within 5 working days.

12. Changes and law

We may update these terms, and we will show the new date at the top. Changes don’t affect spots you have already paid for. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or abroad as a consumer, you keep any rights and can use any courts that your local law gives you.
